Tour Participant Agreement, Waiver, and Release of Liability
Please read carefully before signing. This is a legally binding document.
If you have booked through Sunshine Coast Craft Beer Tours, please note that this brand is operated by Creative Tours, and by participating in this tour, you are entering into a contract with Creative Tours.
This agreement is entered into between Creative Tours (referred to as “the Company”) and the undersigned participant (referred to as “I”, “me”, or “the Participant”) for participation in any tour or activity operated by Creative Tours.
I understand and acknowledge that participation in a tour with Creative Tours may involve risks, including but not limited to:
Transportation in vehicles
Visits to breweries, distilleries, wineries, and other venues
Consumption of alcohol and food
Walking on uneven or slippery surfaces
Exposure to environmental conditions such as weather or wildlife
Interaction with equipment, people, and premises outside the control of Creative Tours
I voluntarily assume all such risks, known and unknown, and accept full responsibility for my participation.
I certify that I am physically and mentally capable of participating in the activities provided during the tour. I agree to notify Creative Tours of any medical conditions, allergies, or dietary requirements prior to the tour.
I understand that alcohol consumption is entirely optional and that I am responsible for my own choices. I will not operate a vehicle under the influence of alcohol after the tour.
If alcohol is consumed during the tour, I acknowledge:
I am 18 years of age or older and will provide valid identification upon request.
I will drink responsibly and understand the risks associated with alcohol consumption.
Creative Tours and its staff reserve the right to refuse service or remove any participant behaving inappropriately or appearing intoxicated.
To the fullest extent permitted by law, I hereby waive, release, and discharge Creative Tours, its owners, employees, agents, affiliates, and partners from any and all claims, liabilities, damages, or expenses that may arise from my participation in the tour, including but not limited to:
Personal injury
Illness (including allergic reactions or foodborne illness)
Property damage or loss
Delays or changes in itinerary
Third-party negligence
I agree to indemnify and hold harmless Creative Tours from any loss, liability, claim, or legal action arising out of or related to my participation in the tour.
I consent to the use of any photographs, videos, or recordings taken during the tour that may include my image for marketing, promotional, or social media purposes, unless I have informed Creative Tours in writing that I do not wish to be photographed or recorded.
This agreement shall be governed by the laws of Queensland, Australia. Any legal proceedings arising from this agreement shall take place in Queensland.
I have carefully read and understood this waiver. I am signing it voluntarily and understand that by doing so I am giving up certain legal rights.
